Terms of Service

PLEASE READ CAREFULLY BEFORE USING JEEVI.

By downloading, installing, accessing, or using the Jeevi application, you agree to be legally bound by these Terms in their entirety.
If you do not agree, you must immediately stop using the application and delete it from your device.
These Terms constitute a legally binding contract under the Indian Contract Act, 1872.

01 About Us & Definitions

Jeevi is a mobile application ("Platform") owned and operated by CITYSAGE INNOVATIONS LLP, a Limited Liability Partnership duly registered under the Limited Liability Partnership Act, 2008, having its registered office at Building Number 60/44, 3rd Floor, Jc Chambers, Panampally Nagar, Panampilly Nagar, Ernakulam, Kerala, India – 682036 (hereinafter referred to as "Company", "We", "Us", or "Our").

These Terms of Service ("Terms") govern the relationship between the Company and any person ("User", "You", "Your") who accesses, browses, downloads, registers on, or uses the Platform in any manner. These Terms are in compliance with applicable Indian laws including but not limited to the Information Technology Act, 2000 ("IT Act"), the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 ("Intermediary Rules"), the Digital Personal Data Protection Act, 2023 ("DPDP Act"), the Indian Contract Act, 1872, the Consumer Protection Act, 2019, and the Arbitration and Conciliation Act, 1996.

Definitions

  • "Vibe" / "Event" – A social event or gathering created and hosted by a User on the Platform.
  • "Host" – A User who creates and manages a Vibe on the Platform.
  • "Guest" / "Attendee" – A User who requests to join or attends a Vibe.
  • "User Content" – Any information, data, text, images, audio, or other content submitted by Users.
  • "Platform" – The Jeevi mobile application and all related services.

02 Eligibility

You must meet ALL of the following criteria to use the Platform:

  • You must be at least 18 (eighteen) years of age. By using the Platform, you represent and warrant that you are 18 or older.
  • You must have the legal capacity to enter into a binding contract under Indian law.
  • You must not have been previously suspended, banned, or removed from the Platform by the Company.
  • Your use of the Platform must comply with all applicable central and state laws of India.
  • You must not be located in a jurisdiction where use of the Platform is prohibited by law.

Age Verification Notice: The Company relies on self-reported date of birth during registration. We do not perform independent identity verification. If you falsely represent your age, you assume full legal responsibility for your use of the Platform and any consequences thereof. The Company bears zero liability for any harm arising from underage access.

03 Account Registration & Security

3.1 Registration Requirements

To access features of the Platform, you must register by providing accurate, complete, and current information including a valid email address, username, date of birth, and gender. You may also register via Google Sign-In or Apple Sign-In.

3.2 Accuracy of Information

You agree to provide truthful, accurate, and current information during registration and to keep your account information updated. Providing false information, including a false date of birth, is a breach of these Terms and may result in immediate account termination.

3.3 Account Security

You are solely responsible for: (a) maintaining the confidentiality of your login credentials; (b) all activities that occur under your account, whether authorised by you or not; (c) any harm caused by unauthorised use of your account. You must notify us immediately at admin@citysage.in if you become aware of any unauthorised access.

3.4 One Account Per Person

Each individual may maintain only one active account. Creating multiple accounts is strictly prohibited and will result in termination of all associated accounts.

3.5 No Transfer

Your account is personal and non-transferable. You may not sell, assign, or share your account with any third party.

No Identity Verification: The Company does not verify the identity, background, criminal history, or trustworthiness of any User beyond the information voluntarily provided during registration. You interact with other Users entirely at your own risk.

04 Nature of the Platform – Intermediary Status

4.1 Technology Platform Only

Jeevi is an online technology platform that provides tools for Users to create, discover, and coordinate social events. The Company's role is strictly limited to providing this technology infrastructure.

4.2 The Company Is NOT

  • An organiser, co-organiser, or operator of any event listed on the Platform;
  • A participant or attendee at any event;
  • A guarantor of the safety, quality, legality, or occurrence of any event;
  • An employer, principal, agent, or representative of any Host or Guest;
  • A party to any agreement between Hosts and Guests;
  • A background check service or identity verification service.

4.3 Intermediary Under the IT Act, 2000

The Company qualifies as an "intermediary" as defined under Section 2(w) of the Information Technology Act, 2000, and is entitled to the safe harbour protections under Section 79 of the IT Act, 2000 read with Rule 3 of the Intermediary Rules,

  • Accordingly, the Company shall not be liable for any third-party information, data,

or communication links made available or hosted by the Company in its capacity as an intermediary.

4.4 User-to-User Interactions

All interactions between Users — including event creation, attendance, communication, and any physical meetings — are solely between the participating Users. The Company bears no responsibility or liability for the conduct, behaviour, statements, or actions of any User, whether online or offline.

05 Events ("Vibes") – Host & Guest Responsibilities

5.1 Host Responsibility – Full and Exclusive

If you create a Vibe, you are the sole and exclusive organiser of that event. You assume complete and undivided responsibility for:

  • The accuracy, completeness, and truthfulness of all event listing information (venue, time, date, conditions, capacity, access requirements);
  • Compliance with all applicable central, state, and local laws, including obtaining any necessary permits, NOC, or licences for the event;
  • The safety, security, health, and welfare of all attendees at your event;
  • Any injury, death, property damage, financial loss, psychological harm, or any other harm that occurs at, or in connection with, your event;
  • All costs, liabilities, fines, penalties, claims, or legal proceedings arising from your event;
  • Ensuring the venue is lawfully accessible and safe;
  • Compliance with applicable provisions of the Bharatiya Nyaya Sanhita, 2023, the Shops and Establishments Act (state-applicable), and all other applicable laws.

5.2 Guest Responsibility – Attend At Own Risk

By requesting to join or attending any Vibe, you acknowledge and accept that:

  • You are voluntarily choosing to meet and interact with strangers whose identities, characters, intentions, and backgrounds the Company has NOT verified;
  • The Company provides no guarantee whatsoever regarding the event, its Host, the venue's safety, the accuracy of the listing, or the behaviour of other attendees;
  • You are solely responsible for your own safety, wellbeing, and decisions;
  • You have exercised your own independent judgment in deciding to attend;
  • You have taken appropriate safety precautions before meeting strangers.

5.3 LGBTQ+ Safe Space Designation

Any event designated as "LGBTQ+ Safe Space" reflects a self-declaration by the Host alone. The Company does not verify, audit, certify, or guarantee the accuracy, safety, or inclusivity of any such designation. The Company expressly disclaims any and all liability arising from reliance on, or breach of, any LGBTQ+ Safe Space designation.

5.4 Gatekeeper & QR Attendance Verification

The QR code-based attendance verification feature is a convenience tool only. It does not constitute identity verification, does not create any duty of care by the Company, and does not imply that the Company has verified or screened any attendee.

5.5 Event Cancellations & Modifications

The Company is not responsible if any event is cancelled, modified, postponed, or does not occur as listed. Any disputes regarding event cancellations are strictly between the Host and Guests.

5.6 Location Data

Location information provided by Hosts is solely to facilitate event discovery. The Company is not responsible for the accuracy of any location information. Sharing precise venue addresses is at the Host's sole discretion and risk.

06 User Conduct

6.1 Lawful Use

You agree to use the Platform only for lawful purposes and in accordance with all applicable laws of India, including but not limited to the Bharatiya Nyaya Sanhita, 2023, the IT Act, 2000, and the DPDP Act, 2023.

6.2 Prohibited Conduct

You must NOT:

  • Create, post, or share false, misleading, defamatory, fraudulent, or deceptive content;
  • Impersonate any person or entity, or misrepresent your identity, age, or gender;
  • Harass, bully, stalk, threaten, abuse, intimidate, or harm any other User;
  • Upload or share content that is obscene, pornographic, sexually explicit, violent, hateful, discriminatory, or promotes self-harm, terrorism, or illegal activities;
  • Use the Platform to solicit money, donations, or gifts from other Users;
  • Use the Platform for commercial solicitation, advertising, or spam without prior written consent;
  • Attempt to gain unauthorised access to the Platform, other accounts, or associated systems;
  • Introduce viruses, malware, ransomware, or other harmful code;
  • Engage in data scraping, crawling, mining, or systematic data extraction;
  • Use automated bots, scripts, or tools to interact with the Platform;
  • Share another User's precise real-time location without their explicit consent;
  • Create events intended to facilitate illegal activities;
  • Violate any applicable central or state laws of India.

07 Communications & User Content

7.1 Your Responsibility

All User Content — including event listings, chat messages, ratings, reviews, profile information, images, audio, and location shares — is your sole and exclusive responsibility. You represent and warrant that your User Content does not violate any applicable laws or third-party rights.

7.2 License to Company

By submitting User Content, you grant the Company a non-exclusive, worldwide, royalty-free, perpetual, sublicensable license to use, store, display, reproduce, modify, and process your User Content solely to the extent necessary to operate, provide, improve, and promote the Platform.

7.3 No Monitoring Obligation

The Company does not proactively monitor all User Content. However, upon becoming aware of content that violates these Terms or applicable law, the Company reserves the right to remove such content without notice.

7.4 Message Encryption

Chat messages are encrypted using industry-standard methods. While we implement reasonable security measures, we cannot guarantee absolute security of your communications. You should not share sensitive personal, financial, or security-critical information in chat.

7.5 Media Content

Images and audio messages shared in chats are stored on secure servers. You must ensure you have the necessary rights to share any media. The Company is not responsible for any media shared by Users.

08 Reputation & Scoring System

8.1 Algorithmic Computation

The reputation scoring system (including Vibe Score, Safety Score, Reliability Score, Contribution Score, Reciprocity Score, and Host Score components) is an automated, algorithmic computation based solely on ratings submitted by other Users. These scores are NOT endorsements, recommendations, or representations by the Company.

8.2 User-Generated Ratings

All ratings and reviews are submitted by Users and reflect their personal, subjective opinions. The Company does not verify the accuracy, truthfulness, fairness, or reliability of any rating or review.

8.3 No Safety Guarantee

Reputation scores are indicators only. They do not constitute a guarantee, warranty, or assurance of future behaviour, trustworthiness, character, or safety. A high reputation score does not mean a User is safe to meet. You must exercise independent judgment.

8.4 No Liability for Scores

The Company is not liable for any decision you make based on reputation scores, nor for any harm arising from meeting or interacting with Users based on their scores.

09 Prohibited Activities

In addition to Section 6, Users must not use the Platform for:

  • Illegal gambling, betting, or wagering of any kind;
  • Solicitation of prostitution, commercial sexual services, or any form of sexual exploitation;
  • Human trafficking or forced labour in any form;
  • Recruitment into or promotion of cults, extremist groups, or terrorist organisations;
  • Promotion, sale, or distribution of substances prohibited under the Narcotic Drugs and Psychotropic Substances Act, 1985;
  • Any activity constituting an offence under the Bharatiya Nyaya Sanhita, 2023, the POCSO Act, 2012, the IT Act, 2000, or any other applicable Indian law;
  • Any form of pyramid scheme, multi-level marketing, or fraudulent money-making scheme;
  • Hosting unlawful gatherings, protests, or assemblies in violation of applicable law.

10 Third-Party Services

10.1 Third-Party Providers

The Platform integrates or relies on third-party services including but not limited to:

  • Supabase Inc. – database, authentication, real-time, and file storage;
  • Google LLC – Google Sign-In authentication;
  • Apple Inc. – Apple Sign-In authentication;
  • Location services provided by the device operating system.

10.2 No Liability for Third Parties

The Company is not responsible for and expressly disclaims all liability regarding the availability, security, data handling, policies, conduct, or actions of any third-party service provider. Your use of third-party services is governed by their respective terms of service and privacy policies, which you are responsible for reading and agreeing to.

10.3 External Links

Any links to third-party websites or services do not constitute an endorsement, affiliation, or sponsorship by the Company.

11 Intellectual Property

11.1 Company Ownership

All intellectual property in the Platform — including the Jeevi name, logo, brand, design, software, algorithms, features, documentation, and all Company-created content — is owned by or licensed to CITYSAGE INNOVATIONS LLP. All rights are reserved.

11.2 Restrictions

You may not reverse engineer, decompile, disassemble, copy, reproduce, redistribute, sublicense, or create derivative works of the Platform or any part thereof without prior written consent from the Company.

11.3 User Content Ownership

You retain ownership of your original User Content, subject to the license granted in Section 7.2.

11.4 Feedback

Any feedback, suggestions, or ideas you submit regarding the Platform may be used by the Company freely without any obligation to compensate or attribute you.

12 Disclaimers & No Warranty

THE PLATFORM IS PROVIDED STRICTLY ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, OR UNINTERRUPTED AVAILABILITY.

12.1 No Warranty of Safety

THE COMPANY EXPRESSLY DISCLAIMS ANY WARRANTY OR REPRESENTATION REGARDING: (a) THE SAFETY OF ANY PHYSICAL EVENTS; (b) THE IDENTITY, CHARACTER, BACKGROUND, OR INTENTIONS OF ANY USER; (c) THE ACCURACY OF ANY USER-GENERATED CONTENT; (d) THE OCCURRENCE OR QUALITY OF ANY EVENT.

12.2 No Background Checks

The Company does not conduct, and does not claim to conduct, any background checks, criminal record verification, identity verification, or any other form of screening of any User.

12.3 Service Availability

The Company does not guarantee that the Platform will be uninterrupted, error-free, secure, or free from viruses, bugs, or other harmful components.

12.4 User Risk – Physical Meetings

ANY PHYSICAL MEETING, EVENT ATTENDANCE, OR REAL-WORLD INTERACTION FACILITATED THROUGH THE PLATFORM IS ENTIRELY AND SOLELY AT YOUR OWN RISK. You acknowledge that meeting strangers carries inherent and potentially serious risks, including the risk of physical harm, sexual assault, robbery, or death. The Company assumes no responsibility for any such harm.

13 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY'S MAXIMUM AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO THE COMPANY IN THE THREE (3) MONTHS PRECEDING THE CLAIM; OR (B) INDIAN RUPEES ONE THOUSAND (₹1,000) — WHICHEVER IS HIGHER. SINCE THE PLATFORM IS CURRENTLY FREE TO USE, THE DEFAULT MAXIMUM LIABILITY IS ₹1,000.

13.1 Excluded Damages

IN NO EVENT SHALL THE COMPANY, ITS DESIGNATED PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SUCCESSORS, OR ASSIGNS BE LIABLE FOR:

  • Any indirect, incidental, special, exemplary, punitive, or consequential damages of any kind;
  • Loss of profits, revenue, data, goodwill, business opportunities, or anticipated savings;
  • Personal injury, bodily harm, sexual violence, assault, death, or property damage arising from any User's attendance at or hosting of any event;
  • Any harm arising from interactions between Users, whether online or offline;
  • Any content posted, shared, or transmitted by any User;
  • Unauthorised access to or alteration of your account or data;
  • Any failure, delay, interruption, or errors in the Platform;
  • Any losses arising from reliance on reputation scores or event listings;
  • Any harm arising from reliance on any LGBTQ+ Safe Space designation;
  • Any force majeure event as described in Section 15.

13.2 Essential Basis

You acknowledge that the limitations of liability in this Section reflect a fair allocation of risk and form an essential basis of the agreement between you and the Company, without which the Company would not have provided the Platform.

13.3 Acknowledgement of Inherent Risk

You specifically and explicitly acknowledge that meetings with strangers arranged through any online platform carry inherent risks of physical, financial, and psychological harm, and that you are voluntarily assuming all such risks.

14 Indemnification

You agree to fully and unconditionally indemnify, defend, and hold harmless CITYSAGE INNOVATIONS LLP and its designated partners, directors, officers, employees, agents, successors, and assigns from and against any and all claims, demands, losses, damages, liabilities, costs, and expenses (including reasonable legal fees and litigation costs) arising out of or in connection with:

  • Your access to, use of, or reliance on the Platform;
  • Any Vibe you host or attend, including any injury, harm, or damage that occurs;
  • Any User Content you create, post, share, or transmit;
  • Your violation of any provision of these Terms;
  • Your violation of any applicable Indian law or third-party rights;
  • Any false or misleading information you provided during registration or on the Platform;
  • Any dispute between you and another User;
  • Any injury, harm, or damage you cause to any third party.

15 Force Majeure

The Company shall not be liable for any failure or delay in the performance of its obligations under these Terms to the extent caused by circumstances beyond its reasonable control, including but not limited to: acts of God, natural disasters, floods, earthquakes, epidemics, pandemics, government orders, war, terrorism, civil unrest, strikes, power failures, telecommunications failures, internet disruptions, or failures of third-party service providers.

16 Account Termination

16.1 Termination by You

You may delete your account at any time through the Platform's settings. Upon account deletion, your personal data will be handled as described in our Privacy Policy.

16.2 Termination by Company

The Company reserves the right, at its sole and absolute discretion, to suspend, restrict, or permanently terminate your account and access to the Platform, with or without notice, for any reason, including but not limited to: violation of these Terms, fraudulent or abusive behaviour, providing false information, or conduct deemed harmful to other Users, the Company, or the Platform's reputation.

16.3 Effect of Termination

Upon termination, your right to access the Platform ceases immediately. Sections 7, 10, 11, 12, 13, 14, 17, and 18 survive the termination of these Terms.

17 Dispute Resolution & Arbitration

17.1 Mandatory Pre-Dispute Resolution

Before initiating any arbitration or legal proceedings, you must first attempt to resolve the dispute amicably by writing to us at admin@citysage.in and allowing a minimum of 30 (thirty) days for the Company to respond and attempt resolution.

17.2 Binding Arbitration

If the dispute is not resolved through the above process, it shall be resolved exclusively through binding arbitration under and in accordance with the Arbitration and Conciliation Act, 1996 (as amended). The arbitration shall be conducted by a sole arbitrator appointed by the Company.

17.3 Seat & Venue

The seat and venue of arbitration shall be Ernakulam (Kochi), Kerala, India. All proceedings shall be conducted in English.

17.4 Costs

Each party shall bear its own costs of arbitration unless the arbitrator determines otherwise. The arbitrator's fee shall be shared equally unless the arbitrator decides otherwise.

17.5 No Class Action

You expressly waive any right to bring or participate in any class action, consolidated action, class arbitration, or any representative proceeding against the Company. All claims must be brought on an individual basis only.

18 Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Subject to the mandatory arbitration provisions in Section 17, the courts of Ernakulam (Kochi), Kerala, India shall have exclusive jurisdiction over any disputes that are not subject to arbitration.

19 Grievance Redressal

In accordance with Rule 3(2)(b) of the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, the Company has designated a Grievance Officer:

Response Time: Acknowledgement within 24 hours; Resolution within 15 days of receipt.

Users may also raise complaints with the appropriate government authority if the grievance is not resolved to their satisfaction.

20 Changes to Terms

The Company reserves the right to modify, update, or replace these Terms at any time. Changes will be effective upon posting the revised Terms at this URL. For material changes, we will notify you through the app. Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
